Official Contest Rules for SFM Audition Contest


NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

  1. Eligibility: The SFM Audition Contest (“Contest”) is open only to legal residents of the fifty (50) United States (including the District of Columbia) who are at least eighteen (18) years old at the time of entry. Employees of Setting The Tone, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
  2. Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Setting The Tone as final and binding as it relates to the content of this Contest.
  3. Contest Period: Entries will be accepted online starting on 5/5/2023 and ending on 5/13/2023. All online entries must be received by 5/13/2023 at 11:59 PM Eastern Standard Time.
  4. How to Enter: The Contest must be entered by submitting a video of your performance to through the official contest submission form at toneloves.com/blog/sfm-contest. The entry must fulfill all Contest requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Setting The Tone. You may enter only once. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Setting The Tone.
  5. Prizes: The Winner(s) of the Contest (the “Winner”) will receive USD 100 in the form of a gift card. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by Setting The Tone. No cash or other prize substitution shall be permitted except at Setting The Tone’s discretion. The prize is non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted.
  6. Ownership Rights: By submitting a video entry, You acknowledge and agree that Setting The Tone shall be the sole and exclusive owner of all right, title, and interest in and to the video submission and all intellectual property rights related thereto. You grant to Setting The Tone the non-exclusive right and license to use, reproduce, modify, display, distribute, and otherwise exploit the video submission, in whole or in part, in any manner or medium now or hereafter known, for any purpose whatsoever, without any further compensation to You or any other person or entity.
  7. Media Release: By submitting a video entry, You grant Setting The Tone the irrevocable right and permission to photograph, record, and/or reproduce your performance as well as to use your name, likeness, voice, and biographical information, in connection with the Contest and the promotion thereof, and any derivative works created therefrom, in any and all media now or hereafter known (including, but not limited to, print, television, film, etc.). You agree that Setting The Tone may use your performance and related materials in any manner, including but not limited to, advertising, publicity, promotion, and editorial use, without any further compensation, notice, review, or consent from You. You hereby waive any right of inspection or approval of any such use of your performance and related materials. You also acknowledge and agree that Setting The Tone may share the footage with a third party for the purpose of evaluating your performance.
  8. General Conditions: In the event that the operation, security, or administration of the Contest is impaired in any way, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Setting The Tone in its sole discretion, Setting The Tone may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. Setting The Tone reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Setting The Tone reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by Setting The Tone to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
  9. Arbitration: Except where prohibited by law, as a condition of participating in this Contest, You agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Georgia having jurisdiction. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and You hereby waive all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Your actual out-of-pocket expenses (i.e., costs associated with entering this Contest). You further waive all rights to have damages multiplied or increased.

  12. Governing Law: These Official Rules and this Contest shall be governed by the laws of the state of Georgia, without regard to its conflict of law provisions.
  13. Amendments: Setting The Tone reserves the right to amend these Official Rules at any time, in its sole discretion, and without prior notice to You.
  14. Winners List: To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Setting The Tone, 3455 Peachtree Rd NE, Ste 513, Atlanta, GA 30326.. Requests must be received no later than 5/10/2023.
  15. Acknowledgement: By submitting a video entry, You acknowledge that You have read and understand these Official Rules, and that You agree to be bound by them.
